What's Changed

Effective January 1, 2012, Eastman Kodak Company, worldwide, converted to Incoterms® 2010 rules - Unless otherwise noted in contracts with suppliers and customers, all business will be conducted at domestic and international levels using these rules.  Here are some things to keep in mind when applying Incoterms® rules in Kodak business:
  1. Be aware that EXW and DDP are not allowed for importing to, or exporting from the European Union, based on Kodak SARL requirements.
  2. Incoterms® 2000 rules are no longer acceptable in certain countries of the European Union. Therefore, items shipping under DDU rules will not be allowed. DAP is the Incoterms® 2010 replacement and should be used instead of DDU.
  3. With regard to US imports, “C” rules, i.e. CPT, CIP, CIF and CFR, should not be applied. Under special circumstances, CPT may be applied but only with prior approval from the US Logistics Mode Management team.
  4. For US importing purposes DAP and FCA terms are preferred rules of choice.
  5. The US and EAMER (Europe, Africa and Middle East Region) require Shipping Instructions for imports to those respective regions. They may be obtained through your primary Kodak contact, e.g. someone from the Purchasing team.
  6. Globally, unless all transportation (door to door) is by inland waterway or ocean the following Incoterms® rules should not be used in Kodak trade: FAS, FOB, CFR or CIF.
  7. CIP and CIF rules should not be used in Kodak business unless required by law or regulation. Marine Insurance Certificates for all modes of carriage may be obtained from the KODAK Corporate Risk Management Office or global representatives of that office if proof of insurance is required. Effective January 1, 2011 - All exporters must comply with European Union ICS (Import Control System) cargo security rules for shipments bound to Europe. Please follow explicit instructions found on the European, African and Middle East Routing Guide, EU Compliance section of this site.

Effective January 1, 2011 - Incoterms® rules used in Kodak global business. Until further notice, Kodak continues to apply Incoterms® 2000 rules in it's business. Please do NOT apply Incoterms® 2010 rules until such time as the corporation officially transfers to this version.

Effective February 15, 2011 or upon receipt of Shipping Instructions - All US ISF (Importer Security Filing) reporting to Kodak US Import Service MUST be handled by the seller, shipper or designated agent, not the transportation carrier/forwarder network. See ISF requirements on the United States Routing Guide, ISF Pre-Notification section of this site.
