  11. While you may use the TPX to provide information about a business that might be of interest to other users (without spamming them), the TPX is not to be used as a platform for you to contribute content which may be considered an advertisement for a product, service or business, or posting items for sale from your company, business or storefront. Kodak is not responsible for any products, services or businesses which may be found posted in the community and the purchase or use of any product, service or business that is posted within the TPX is solely at your own risk, and Kodak assumes no liability for such purchase or use.

Contributions, Ownership, Rights and Liability

As a registered user of the TPX, you will have the opportunity to actively participate by creating, providing, sharing and uploading information to the TPX such as projects, comments, designs, ideas or suggestions and other information (collectively “Contributions”). Contributions in the TPX are subject to these Terms and the Site Terms. Kodak assumes no responsibility or liability over the sharing of Contributions among users.

Any Contributions provided by you to the TPX may be editable and freely used by the TPX Community. Ways in which your Contributions may be used include, but are not limited to, creating projects, comments, articles, documents, tips and techniques. For example, users may incorporate ideas written by others to create a new project. Kodak shall have the right to retain and use Contributions, in edited or unedited form, for any purpose in any way including but not limited to re-posting such Contributions to other areas of the Kodak website and using Contributions in current or future products or services. By displaying, publishing, or otherwise posting any Contributions to the TPX, you hereby grant to Kodak a limited, non-exclusive, sub-licensable, worldwide, fully-paid, royalty free license to use, modify, publicly perform, publicly display, reproduce, and distribute such Contributions without the requirement to make payment to you or to any third party or the need to seek any third party permission. This license includes the right to host, index, cache, distribute, and tag any Contributions, as well as the right to sublicense Contributions to third parties, including other users, for use on other media or platforms known or hereinafter developed.

Do not upload Contributions to the TPX unless you agree to these Terms. Kodak is under no obligation to (i) compensate you for any Contributions, or (ii) post or use any Contributions provided by TPX users, and Kodak may in fact remove any Contributions at any time at its sole discretion for any reasons.

You represent and warrant that you own the content submitted, displayed, published or posted by you on the TPX and otherwise have the right to grant the license set forth herein, and the displaying, publishing or posting of any content you submit, and our use thereof, does not and will not violate the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other intellectual property rights or other rights of any person or entity.

You agree to indemnify and hold Kodak, its parents, subsidiaries, officers, employees, and website contractors and each of their officers, employees and agents harmless from any claims, damages and expenses, including reasonable attorneys' fees and costs, related to your violation of these Terms.

Your Privacy

Kodak will treat any information it collects from you through the TPX in accordance with Kodak’s Online Privacy Policy, which is hereby incorporated by reference.
