The Colors of Life

OFFICIAL PHOTO CONTEST RULES, REGULATIONS AND CATEGORY DESCRIPTIONS

All images must be shot on KODAK PROFESSIONAL Color Film

Please read the rules in their entirety. All entries not complying with the rules will be disqualified.
1. Contest open only to legal residents of the 50 United States and Washington, D.C., 18 years or older at time of entry. Employees of Eastman Kodak Company (Sponsor), Hachette Fillipacchi Media US Inc., and all of their subsidiaries, affiliates, agencies, judges and their immediate families are excluded.

2. Only images taken on KODAK PROFESSIONAL Color Film are eligible for entry. Physical images submitted will not be returned to the entrant. Photo, or one substantially similar to it, may not have been published, nor have won, or be currently entered in, any other photo contest. No alteration or retouching of original image or print is permitted. Photo must have been taken by entrant and must depict one of the 3 categories of "Colors of Life" -

•  Landscapes/Nature - inspiration and beauty that only nature can provide
•  People/Lifestyle - depict the Color of Life through people
•  Wildlife/Animals - ranging from natures wildlife to the household pet

3. No entry fee is required. Multiple entries are allowed per entrant, with a limit of one submission (mail or email) per day. Each unique photo submitted must have a completed official entry blank attached. Do not enter the same image multiple times; it will not increase your chances of winning. Do not write on photos. Information required on the entry form must be accurate and legible in order for the image to qualify. Required information for the entry form includes - full contact name/information, mail and email address of entrant, film on which image was captured, definition of Professional (defined as 5% or more of your personal income derived from photographic activity) or Advanced Amateur (defined as less than 5% of your personal income derived from photographic activity) level and a category of submission as listed in item #2 above. Entrant must be the photographer who captured the image and he/she must own all rights to the image. Model releases are required where appropriate and are the responsibility of the photographer. Pornographic images and any image that at any stage involved cruelty or violence to humans or animals/wildlife will not be permitted and will be disqualified.

4. Photos for "The Colors of Life" will be accepted digitally and by mail.

•  Mail Entries must be postmarked no later than Thursday, September 30, 2004 and received no later than October 15, 2004. All entries are to be mailed with correct postage to:
Eastman Kodak Company, Colors of Life , 343 State Street, Rochester, NY 14650-0536.
Sponsor is not responsible for illegible, incomplete, mutilated, lost, late, or postage due entries. To minimize risk, we suggest you retain any unique photographs and submit only replaceable items. Entries will not be returned and may be retained or disposed of at Sponsor's discretion. Color prints must be no smaller than 3 1/2" x 3 1/2" and no larger than 11" x 14". Limit to mail in entries is one per day.
•  Digital entries must be received by 11:59 p.m. EDT on Thursday, September 30, 2004. Digital entries are to be emailed to colors@hfmus.com with the appropriate entry form detail forwarded as a result of the confirmation email that was sent to you as a function of the electronic submission process. Digital images received without the entry information form will not be accepted - this form and process are available online at www.kodak.com/go/Colorsoflife Only one digital image may be submitted per entrant per day and each entry must be accompanied by a unique forwarded email entry form. All entries submitted digitally must be supplied as a JPEG file and must be a result of an image taken on KODAK PROFESSIONAL Color Film and then scanned in the form of a digital print or digital file.


5. Only photos complying with the rules may win. Photos will be judged by a qualified panel of judges on the basis of 1) originality, 2) photographic quality, 3) subject interest and 4) visual appeal including use of color. Each criterion to be given equal weight. The contest will be judged by a panel of judges selected by the Sponsor, and may include employees of the Sponsor. The decisions of the judges are final and binding. An odd number of judges will be placed on the panel to minimize the chances of a tie. In the event of a tie between 2 images, the judges will be asked to recast their votes based only on those top 2 images to break the tie.

6. Prizes will be awarded at 2 levels based on entry submission – Professional level and Advanced Amateur level to be judged and awarded separately (provided a reasonable number of qualified entries is received):

Second Place Total retail value of $1,500  
•  Image will appear on the Kodak and Pop Photo Websites
•  (1) KODAK PROFESSIONAL 8500 Digital Photo Printer and (1) 50 Print EKTATHERM 8500 Glossy Kit
•  $350 retail value of your choice of KODAK PROFESSIONAL ULTRA COLOR Films. (More than 2,000+ exposures)
Third Place Total retail value of $500  
•  Image will appear on the Kodak and Pop Photo Websites
•  $500 retail value of your choice of KODAK PROFESSIONAL ULTRA COLOR Films. (More than 3,000+ exposures)


Professional LEVEL

•  $350 retail value of your choice of KODAK PROFESSIONAL PORTRA Films. (More than 1,750+ exposures)
Third Place Total retail value of $500  
•  Image will appear on the Kodak and American Photo Websites
•  $500 retail value of your choice of KODAK PROFESSIONAL PORTRA Films. (More than 2,500 exposures)

Approximate value of prizes is $4,500 x 2 levels = $9,000 Total based on manufacturer suggested retail prices.


7. Winners will be notified by registered mail and required to sign and return within 21 days of notification an affidavit of eligibility and release of liability, together with model releases from all recognizable persons pictured in the photo. Winners must be able to prove that the image was taken on a KODAK PROFESSIONAL Color Film by submitting the original film negative from the image submitted. Only winners will be required to submit their film negative and the winning negatives submitted will be returned to the entrant. To the extent permitted by law, winners will also be required to grant Kodak and Hachette Fillipacchi Media use of the winning photo, together with their names, likenesses and biographical information, in advertising and publicity about the Contest or future contests without further compensation. Failure to comply with all these conditions may result in prize forfeiture. Prizes will be awarded within 4-6 weeks of receipt of the signed affidavit.

8. By entering, you agree to release Sponsor and associates, their employees and representatives from all claims and liabilities in connection with this Contest or with any of the prizes.

9. Limit one prize per person, family or household. Winners may not transfer prize rights nor obtain substitutions or cash redemptions. All taxes on prizes and incidental expenses not specified in the above prize descriptions are solely the responsibility of winners. Offer void where prohibited by law.

10. Sponsor reserves the right to disqualify anyone who, in their opinion, has tampered with or disrupted the entry process or operation of this contest or violated the rules. If the contest cannot be run as planned for any reason, including technical problems, sponsors reserve the right to cancel, curtail, modify or suspend the contest. In the event the contest is terminated early, winners will be selected from all eligible entries received at the time of termination and will include all mail in entries postmarked on termination day and all electronic entries submitted prior to the termination.
