Personal Privacy Statement for the My Kodak Moments App,
Kodak Kiosk Connect and Kodak Moments HD App

Kodak Alaris Inc. (“Kodak Alaris”) is committed to protecting your privacy online. Our pledge is to safeguard any personal information that you provide us, and to make every reasonable effort to use this information only as you choose. Kodak Alaris is also a participant in the Safe Harbor program between the US and the European Union, as well as the Safe Harbor program between the U.S. and Switzerland. Any personal data collected as described below will be transmitted to Kodak Alaris’ servers in the United States or Europe and handled as required by the Safe Harbor principles.

Scope of This Notice

The goal of this Privacy Notice is to advise you of the personal information that Kodak Alaris collects when you use the My Kodak Moments App, the Kodak Kiosk Connect App or the Kodak Moments HD App (“the App or Apps”), and how we use that information. The Privacy Notice also describes the choices you have regarding how this information is used.

How We Collect and Use Your Personal Information

Kodak Alaris' primary goals in collecting your personal information are to:

  1. provide an enjoyable, personalized experience while using the Apps,
  2. tailor our communications to match your interests, and
  3. facilitate the development of new products and services relevant to consumers like you.

Here are the types of personal information we gather, and how we use it.

  1. Information Shared When You Install the Apps
    The Apps are mobile applications that help you create photo products from images accessible on your mobile device by submitting the images to a Kodak Alaris server for fulfillment in-store, to a Kodak Alaris server for fulfillment at a central photo lab for products to be shipped to home, or to a Kodak Alaris Picture kiosk. In order to use Apps, you must give the Apps permission to use certain functionality. By giving the Apps permission to use your mobile device, you agree to allow Kodak Alaris to use the information as described in this Notice. In order to complete installation of the Apps, you must provide Kodak Alaris with the following permissions:

    Location Services Your coarse location. Your coarse location is used to search for retail stores near you that can fulfill your order.
    Photos The images you select on your mobile device, their image names and their folder names. The images and associated data are used to create your photo products.

    Your location Your location is used to search for retail stores near you that can fulfill your order.

    Write External Storage No information is collected We write session id data to allow you to restart the App and resume at the point in the workflow where you left the App.
    We write a summary about your images to allow faster selection for future uses.

    Access and Change Network and WiFi or WiFi Multicast State No information is collected Use to check for a proper network connection and change it if required.
    Power Management – Wake Lock No information is collected Use to keep the mobile device from powering down while connected to a kiosk or Kodak Alaris server.
    Camera No information is collected Use to read a QR code to make a connection to a kiosk.
    Read Phone State A non-reversible, encrypted SHA256 hash of your device ID IMEI number to create a unique ID but it can not be used to determine what device the data came from. Use to evaluate your use of the app.

  2. Information Shared When You Create or Order a Photo Product On-line
    1. When you are in the process of working on a photo product in the prints workflow, the App is using a Kodak Alaris server. A Kodak Alaris session id is stored locally on your mobile device so that you can continue working on photo products using the application. This information is deleted if you start the application again. Session information is deleted after the order has been placed.
    2. When you are in the process of working on a photo product, the following information regarding each selected photo is also sent to Kodak Alaris: the photo image and its associated image tags that are contained in the image file. This information is temporarily stored at Kodak Alaris and then deleted after 2 days with no continued activity, or when you begin using the App again. When you print a photo product, this information is temporarily stored at Kodak Alaris and then deleted after 30 days. When you store and share a photo product, this information is temporarily stored at Kodak Alaris and then deleted when you delete the photo product that you stored and shared.
    3. When you submit for printing a photo product, the App may ask you for identification information. This data may include your first name, last name, telephone number, and e-mail address. This data will be associated with your photo product order and then deleted 6 months after the order is completed or cancelled.
  3. Information We Automatically Collect
    1. At installation time, you will be asked for your consent to track your usage of the App and to record non-personally identifiable data. This data will be recorded in the form of Cookies and web beacons. We use Google Analytics or Localytics to track your usage of the App. If you do not consent to using performance cookies for usage tracking, the analytics function will not collect information.
    2. Cookies: Cookies are small pieces of information stored by the App in your mobile device, at a web site's request.

      Kodak Alaris “strictly necessary cookies” do not contain any personal information, and are used primarily as follows:
      • to manage and present site information and the pictures displayed on your computer;
      • to deliver information specific to your interests; and
      • to manage images associated with photo products like on a shopping cart screen.

      Some apps use Localytics, a web analysis service. Localytics collects a non-reversible, encrypted SHA256 hash of your device ID IMEI number to create a unique ID. The unique ID can not be used to determine what device the data came from. Localytics uses “performance cookies,” which are text files placed on your mobile device, to help the app analyze how users use the app. The information generated by the cookie about your use of the app will be transmitted to and stored by Localytics on servers in the United States. Localytics will use this information on behalf of the app operator for the purpose of evaluating your use of the app, compiling reports on app activity, and providing other services to app operators relating to app activity and Internet usage. You may prevent the use of Localytics by unselecting the appropriate setting in the app’s setup screen.
    3. Web Beacons: We also place small "tracker gifs" or "beacons" on many of the screens in our Apps. With your consent, we use these beacons, in connection with cookies, to collect data on the usage of our Apps including but not limited to the date and time of your usage, the screens or functions used, the type of operating system (e.g., iOS or Android), and the domain name of the user's Internet service provider (e.g., Verizon). This information is collected about thousands of App uses and analyzed as a whole. This information is useful in, for example, tracking the performance of our App.

Does Kodak Alaris Share Your Information?

Your personally identifiable information will not be rented or sold to any third party. Kodak Alaris may share your personal information as follows:

  1. Companies who work on our behalf: We contract with other companies to perform business support functions on our behalf, which may involve limited access to your personal information. We require these companies to use the information only to provide the contracted services; they are prohibited from transferring the information to another party except as needed to provide those services. Some examples of these business support functions include order fulfillment, coupon fulfillment, award and rebate fulfillments, customer survey execution; and information systems management. We also may make aggregate non-personal information available to select service providers.
  2. Kodak Alaris' Affiliates: "Affiliates means any company, partnership, joint venture, or other entity that directly or indirectly controls, is controlled by or is under common control with a Party. For the purpose of the preceding sentence, one legal entity controls another legal entity means that the former possesses the right to appoint more than 50% of the positions on the board of directors of the latter. We may share your information with an affiliate, with the requirement that they not transfer your information to another party for marketing purposes, or use your information contrary to your expressed choices. Similarly, if one of our affiliates shares your information with us, we will not transfer your information to another party for marketing purposes or use your information contrary to your expressed choices.
  3. Business Transfers: Kodak Alaris reserves the right to transfer your personal information in connection with the sale or transfer of all or a portion of our business or assets. If the business is sold or transferred, Kodak Alaris will transfer such information to the new business owner. In some cases, this may mean that the new organization will not be able to continue providing to you the services or products that Kodak Alaris provided.
  4. Law Enforcement: Kodak Alaris may disclose personal information to third parties without your consent for any of the following reasons: to comply with any law, regulation or court order, to cooperate with Government investigations, to help prevent fraud or to enforce or protect the rights of Kodak Alaris or its subsidiaries.
  5. With Your Consent: In all other cases, Kodak Alaris will obtain your express consent before sharing your information with third parties. For example, Kodak Alaris may conduct a joint offer or contest with a third party and you will be asked whether your personal information should be shared with that third party.

Your Choices about Receiving E-mail

Kodak Alaris may send you e-mail about your orders and in response to your questions.

How You Can Remove Information
You can request Kodak Alaris to remove all your App data stored by Kodak Alaris by notifying our privacy office. See the “How to Reach Us” section below for details.
Removed information may persist in backup copies for up to 100 days.

Protecting Your Information
Kodak Alaris implements a variety of administrative, managerial, and technical security measures to help protect your personal information. Kodak Alaris has Internal Control Standards which relate specifically to the handling of personal information. These include certain controls to help safeguard the information we collect online.

Kodak Alaris employees are trained to understand and comply with these controls and we communicate our Privacy Notice, practices and guidelines to our employees. However, while we strive to protect your personal information, you must also take steps to protect your information. We urge you to take every precaution to protect your personal information while you are on the Internet.

Children's Privacy
Protecting the online privacy of children is especially important, and those under the age of 13 are protected by United States federal law. For that reason, Kodak Alaris does not knowingly permit children under the age of 13 and in the US to download the App, or to buy goods and services on our sites, without verifiable parental consent. Kodak Alaris does not knowingly collect or solicit personal information about children under 13, except with their parent's express consent.

If we ever include children under the age of 13 as part of our intended site audience, those specific web pages will, in accordance with the provisions of the Children's Online Privacy Protection Act (COPPA) of the US, be clearly identified and provide an explicit privacy notice; and we will provide processes to obtain parental approval, provide access to information and allow parents to request removal of their children's personal information.

Kodak Alaris encourages parents and guardians to spend time with their children online and to participate in their interactive activities and interests.

Keeping Your Information Accurate
You may send an e-mail to the address noted in the "How to Reach Us" section below to request a change to your information or a copy of the personal information we have collected about you online. There may be a nominal charge for information requested. We will make every reasonable effort to make sure your requests are met. To protect your privacy, proof of identity is required.
